In this law review publication, I propose a new constitutional framework within which people charged with drug and alcohol-related crimes could be remanded to treatment programs instead of incarceration to lower the statistical probability of recidivism for the same or similar crimes (i.e., successful treatment for one's alcoholism would necessarily negate the possibility of another DUI). The only caveat being that a failure to complete the rehabilitation program resulted in a violation of probation and a free trip to jail.
