Job Description

Visa is seeking a senior marketing and advertising attorney to join the Global Product, IP and Services legal team and serve as the lead attorney who will be responsible for advising and supporting Visa Marketing's internal creative agency Ad Hock and Ad Hock's supported marketing of Visa's partners and clients. The position is for a Senior Managing Counsel, who will report to the Vice President who leads the Marketing Legal team. The position is based in Foster City or San Francisco, California.

Applicants must be experienced in both advising on legal issues related to creative production and have experience in payments or financial institution marketing, applying knowledge of the FTC and CFPB rules and regulations and the current legal and regulatory framework. Applicant should be skilled at managing multiple priorities in a fast-paced and challenging, but highly rewarding, environment, have good judgment and strong analytical, counseling, and negotiation skills, be self-motivated, and most importantly, be an optimistic, curious, and collaborative team player.

Essential Functions

Visa Is Looking For Someone Who Will:
• Manage legal review of diverse marketing and promotion activity by the Ad Hock team, including oversight of complex promotion and publicity events, offers, sweepstakes, influencer engagements, original creative content creation, media integration, and advising on clearances, including rights analysis.
• Provide legal advice on marketing and advertising for payment products and services, including providing guidance to Marketing regarding new regulatory developments impacting Visa Marketing and the Ad Hoc supported marketing of Visa's partners and clients.
• Draft, review and negotiate a wide variety of creative and production related contracts.
• Collaborate with Ad Hoc business affairs and creative leads.
• Build processes and ways of working for a new growing internal creative agency.

This position requires a business savvy team player who is collaborative with marketing and legal colleagues and can work with minimal supervision.

This is a hybrid position. Hybrid employees can alternate time between both remote and office. Employees in hybrid roles are expected to work from the office 2-3 set days a week (determined by leadership/site), with a general guidepost of being in the office 50% or more of the time based on business needs.

Qualifications

Basic Qualifications
- 12 or more years of work experience with a Bachelor's Degree or at least 10 years of work experience with an Advanced degree (e.g. Masters/MBA /JD/MD), or a minimum of 5 years of work experience with a PhD

Preferred Qualifications
- 15 or more years of experience with a Bachelor's Degree or 12 years of experience with an Advanced Degree (e.g. Masters, MBA, JD, or MD), PhD with 9+ years of experience
- Juris Doctorate degree from an accredited law school
- 12+ years of relevant legal experience
- Prior experience in marketing legal role or creative production legal role required
- Current member in good standing of a state bar in the United States with the ability to become barred or a registered in-house counsel in the state where this role is located
- 9+ years in providing advice on marketing legal creative production legal issues (either in-house or as external counsel)
- Experience advising on legal and regulatory requirements for banking or financial services advertising
- Experience leading a team of attorneys and legal professionals
- Experience building legal support processes for new or evolving business offerings with strong organizational skills, prior project management experience is a plus
- Prior in-house experience preferred
- Must possess exceptional analytical ability and advocacy skills, drive execution in a team environment, and the ability to integrate legal advice and business knowledge, while providing balanced advice regarding risks and benefits
- Effective verbal and written communication skills in all interactions with marketing clients, senior management, legal colleagues, external counsel, corporate departments and all levels of employees
- Developed business acumen, with ability to understand the company's business interests and anticipate the nature and magnitude of issues that could arise in various settings
- Practical and proactive problem-solver with a strong business acumen, must be confident, mature and calm under fire

Additional Information

Work Hours: Varies upon the needs of the department.

Travel Requirements: This position requires travel 5-10% of the time.

Mental/Physical Requirements: This position will be performed in an office setting. The position will require the incumbent to sit and stand at a desk, communicate in person and by telephone, frequently operate standard office equipment, such as telephones and computers.

U.S. APPLICANTS ONLY: The estimated salary range for a new hire into this position is 230,700 to 300,000 USD per year, which may include potential sales incentive payments (if applicable). Salary may vary depending on job-related factors which may include knowledge, skills, experience, and location. In addition, this position may be eligible for bonus and equity.
