A law firm is seeking a highly experienced Senior Advertising, Marketing, and Promotions Attorney to join their dynamic legal team in San Diego, CA. The ideal candidate will possess extensive expertise in advertising law, consumer protection law, and marketing transactions. This role involves drafting and negotiating various agreements, providing counsel on compliance issues, and advising on dispute resolution. The candidate must have strong attention to detail, excellent legal writing and communication skills, and experience in a large or medium law firm setting.

Key Responsibilities

• Draft and Negotiate Agreements:
  • Ad agency agreements
  • Influencer and celebrity endorsement contracts
  • Sponsorship and online media buying agreements
  • Marketing and promotion agreements
• Review and Counsel:
  • Ad copy for false advertising, claim substantiation, IP, and right of publicity issues
  • Contest and sweepstakes compliance
  • Price advertising and recurring subscription programs
  • Loyalty and rewards programs
• Legal Disputes and Compliance:
  • Handle disputes related to false advertising and unfair competition
  • Represent clients in National Advertising Division disputes
  • Provide ongoing legal counsel on consumer protection laws and regulations
• Collaboration and Group Work:
  • Work collaboratively with other attorneys and legal staff within the firm
  • Offer strategic legal advice to clients in conjunction with other team members

Qualifications

• Education:
  • Juris Doctor (JD) degree from an accredited law school
  • Active membership in the California State Bar
• Experience:
  • Substantive experience in advertising law, consumer protection law, and marketing transactions
  • Experience in a large or medium law firm setting is strongly preferred
  • Proven track record in handling false advertising, unfair competition, and National Advertising Division dispute work
• Certifications:
  • Additional certifications in Intellectual Property (IP) law or consumer protection law are a plus
• Skills:
  • Exceptional legal writing and communication skills
  • Strong attention to detail
  • Ability to work effectively in a team-oriented environment
  • Excellent negotiation and contract drafting skills
  • Proficient in analyzing complex legal issues and providing sound legal advice
