Job Overview: A law firm based in Boise, ID, seeks a highly skilled and experienced Senior Advertising Marketing and Promotions Associate Attorney. The ideal candidate will have substantial expertise in advertising law, consumer protection law, and marketing transactions. This role involves drafting and negotiating various marketing agreements, reviewing ad copy, and providing counsel on advertising and promotion issues. The successful candidate will demonstrate exceptional legal writing and communication skills, a solid attention to detail, and the ability to collaborate effectively within a team.

Duties and Responsibilities:

• Draft and negotiate advertising agency agreements, influencer contracts, celebrity endorsements, sponsorship deals, online media buying agreements, and other marketing and promotion contracts.
• Review advertising copy for compliance with false advertising laws, claim substantiation requirements, intellectual property issues, and right of publicity concerns.
• Provide legal counsel on compliance matters related to contests, sweepstakes, price advertising, recurring subscription programs, and loyalty/rewards programs.
• Advise clients on regulatory requirements and best practices for marketing and promotional activities.
• Handle disputes about false advertising, unfair competition, and National Advertising Division matters.
• Collaborate with clients and team members to develop strategies and solutions for complex marketing and advertising legal issues.
• Stay updated on changes in advertising laws and regulations to ensure compliance and mitigate legal risks.

Requirements:

• Minimum of 7 years of relevant experience in advertising law, consumer protection law, and marketing transactions.
• Proven experience drafting and negotiating marketing-related agreements and providing legal counsel on advertising compliance issues.
• Experience with false advertising, unfair competition, and National Advertising Division dispute work is preferred.
• Strong attention to detail and ability to work effectively in a team environment.
• Excellent academic credentials and outstanding legal writing and communication skills.
• Experience in a large or medium-sized law firm setting is preferred.

Education:

• Juris Doctor (J.D.) degree from an accredited law school.

Certifications:

• Admitted to practice law in Idaho (or the ability to obtain admission upon hire).

Skills:

• Expertise in advertising law, consumer protection law, and marketing transactions.
• Strong drafting and negotiation skills for marketing and promotion agreements.
• Proficiency in reviewing and analyzing advertising copy for compliance with relevant laws and regulations.
