SUMMARY
The Counsel, Marketing and Advertising will manage a broad range of advertising and marketing issues across the organization and play an integral role as a core member of the Marketing Department. The attorney will work closely with stakeholders across the company to address day-to-day marketing issues and compliance needs. The individual in this role oversees rights management and advertising asset management, ensuring secure and compliant handling of materials aligned with legal and regulatory standards. The Counsel will proactively integrate AI-driven solutions responsibly while safeguarding the integrity of the company’s brand and campaigns.
ESSENTIAL DUTIES AND RESPONSIBILITIES include the following. Other duties may be assigned.
- Serve as the lead legal advisor to the Marketing leadership team. Offer strategic legal advice on advertising, marketing, and promotional activities to ensure compliance with federal, state, and local regulations, including FTC guidelines, and consumer protection laws.
- Evaluate and approve advertising content, marketing campaigns, promotional materials, and social media strategies. Provide counsel on legal compliance for promotional activities, including sweepstakes, contests, and loyalty programs.
- Draft, review, and negotiate a variety of agreements related to marketing initiatives, including influencer, sponsorship, advertising agency, intellectual property licensing, promotion and sponsorship, media buying, professional services, and vendor agreements.
- Identify potential legal risks in advertising and promotional activities and deliver actionable recommendations to mitigate these risks.
- Advise internal business partners on digital content and social media issues, including disclosure requirements and endorsement guidelines.
- Advise internal business partners on rights clearances, including music licensing, personality rights, and similar risks that may exist in assets being published.
- Draft and maintain advertising and marketing policies.
- Advise on proper trademark and copyright usage, and brand protection within marketing materials and campaigns.
- Stay current on legal developments, emerging issues, and best practices in advertising, marketing, and promotions law, and provide proactive guidance on regulatory changes impacting the business.
QUALIFICATIONS and EXPERIENCE
- Juris Doctor (JD) degree from an accredited law school.
- Member in good standing of a U.S. state bar.
- Minimum of 3-8 years in advertising, marketing, and promotions law, either in-house or at a law firm.
- Expertise in intellectual property, lifecycle optimization of creative assets, and compliance with evolving policies. Strong understanding of AI technologies and their marketing applications, including the ability to identify and mitigate risks related to bias and misuse, is critical.
- Deep understanding of U.S. advertising laws, FTC regulations. Knowledge in privacy and consumer protection laws particularly regarding the collection, storage, and usage of consumer data is a plus.
- Experience working with brands, advertising agencies, publishers and other content providers.
- Exceptional communication and negotiation skills, with the ability to articulate complex legal concepts to non-legal stakeholders. Strong attention to detail, organization, and leadership abilities.
- Ability to work with minimal supervision and exercise independent judgment and discretion.
- A strategic thinker with a proactive, solution-focused approach to identifying legal risks. Skilled in collaborating effectively with diverse stakeholders across the business.
