Duties and Responsibilities:
- Draft and negotiate agreements related to advertising and marketing, including ad agency, influencer, celebrity endorsement, sponsorship, online media buying, and other promotional deals.
- Review and analyze advertising copy for compliance with false advertising laws, claim substantiation, intellectual property (IP) rights, and right of publicity issues.
- Provide counsel on compliance with contest and sweepstakes regulations.
- Advise on price advertising and recurring subscription program compliance.
- Offer guidance on loyalty and rewards programs.
- Address issues related to false advertising, unfair competition, and National Advertising Division disputes.
- Collaborate with internal teams to ensure alignment on legal matters related to advertising and marketing.
Requirements:
- Juris Doctor (JD) degree from an accredited law school.
- Admission to the Bar in the state of Oregon.
- Substantial experience in advertising law, consumer protection law, and marketing transactions.
- Proven track record of drafting and negotiating complex marketing agreements.
- Experience with false advertising, unfair competition, and National Advertising Division disputes is a plus.
Certifications:
- Active Bar membership in the state of Oregon.
