Job Overview: A law firm in Austin, TX, is seeking a highly experienced Senior Advertising Marketing and Promotions Associate Attorney. This role demands an attorney with significant experience in advertising law, consumer protection, and marketing transactions. The ideal candidate will possess strong attention to detail, exceptional legal writing and communication skills, and a proven ability to thrive in individual and team settings.

Duties:

  1. Draft and negotiate advertising agency, influencer, celebrity endorsement, sponsorship, online media buying, and other marketing and promotion agreements.
  2. Review ad copy for compliance with false advertising, claim substantiation, intellectual property, and right of publicity issues.
  3. Provide counsel on contest and sweepstakes compliance, price advertising, recurring subscription programs, and loyalty/rewards programs.
  4. Advise on false advertising, unfair competition, and National Advertising Division disputes.
  5. Collaborate with clients and internal teams to develop and execute effective advertising and marketing strategies.
  6. Maintain up-to-date knowledge of relevant advertising regulations and industry trends.
  7. Conduct legal research and provide actionable insights to support marketing initiatives and compliance.
  8. Prepare and deliver presentations on advertising law issues to clients and internal stakeholders.

Requirements:

  1. Minimum of 7 years of relevant experience in advertising law, consumer protection law, and marketing transactions.
  2. Proven track record in drafting and negotiating various marketing and promotion agreements.
  3. Experience with false advertising, unfair competition, and National Advertising Division dispute work preferred.
  4. Strong attention to detail and ability to work effectively in a team environment.
  5. Excellent academic credentials and outstanding legal writing and communication skills.
  6. Experience in a large or medium law firm setting is preferred.

Education:

  1. Juris Doctor (JD) degree from an accredited law school.
  2. Admission to the Texas State Bar or eligibility for admission.

Certifications:

  1. Licensed attorney in good standing with the Texas State Bar (or eligibility for admission).

Skills:

  1. Expertise in advertising law, consumer protection law, and marketing transactions.
  2. Proficient in drafting and negotiating complex agreements.
  3. Strong analytical and problem-solving skills.
